Hi, I need an opinion about legal and moral situation.
I had my tracker fully checked by a suki mechanic about three months ago and all was well. It passed all em and safty tests . I even had the timing belt replaced.
I put my tracker up for sale and told the buyer to take it to his mechanic to verify that all was in perfict working order.The buyer's machanic also verified that the tracker was in perfict working order. But when the machanic took the tracker for a test drive the timing belt broke and the tracker had to be towed to the shop. the damage to the motor is not yet known.
Now the question is ,who is legaly responsible for the repairs and who is moraly responsible for the repairs.
if you had the belt and idler replaced and the water pump did not sieze
then its bad mechanics parts.
other wise its on you.
best course is to replace all parts that can take out the belt.
if 16v , do pump, belt and idler . if you dont want bent valves.
if 8v then its only a walk home and 3 hours more labor.
moral , not an issue.
if you asked for belt to be changed and he did then what moral issue is that?
if you asked for A1 top 60k or 120k full service point with idler and pump, and paid for top brand parts, you should have got that.
it all depends on what you asked for.
the issues is implied warranty, read the back of repair order , it will all be there .
this is why mechanics charge $800 for $150 belt job, to cover the legal issues.
problem is everyone gets screwed.

Hi, from day one I have always replaced the new timing belt, ideler and water pump at the same time. The cause was a defictive belt. This belt has been examined buy several different people including myself and we all agree that it was defictive.
It was a 16v 97 4x4 auto.---mint body
We resolved the situation to everyones satisfaction , the buyer and me.The buyer bought the tracker at a lower fair price . And I recived a fair lower price. We are both happy.
I was just curius as to what the law has to say and what is morally correct.
if the idler didnt fail
and the tension was not set like Static Serpentine belt ( many just assume they set the belt like that at 125 lbs. and will kill any tbelt fast.)
id bet if this is a top Dayco,gate, or delco or , Beck belt , that it was not tensioned per FSM.
if it is a top brand , id bet on bad procedure.
but stuff happens.
no proof , no pointing fingers.
proof is hard won.
no way to call a defective belt, unless you can prove the tension.
no way at all.
unless it evaporated, or turned back to Dino OIl.
it will snap or fray with the illegal tension i see all the time by some ppl that love to guess.
see belts so tight ,like a E sting on a Violin.
that is my 2cents. conclusion , no proof ,no fingers.

Nope no rabbits foot yet, I have no idea if valves are bent. The buyer will tell me if there is damage later this weekend. The failed belt looks like it was cut clean. no frayed edges. I have never seem a belt brake like this. Supid me bought the belt at Canadian Tire. dumb.dumb.dumb......

But have just bought 2000 Grand Vitara v6 24v auto.

Sounds to me,
you think the belt was "cut" purposely maybe to get a lower price?
I would get it fix and find another buyer, my .02cents

Well, that was my only thought-
Who supplied the part? If you gave it to the mech to install; yes you.
He provided- well that's a little more dicey.
Glad to hear it worked out to everyone' satisfaction.
I was there when belt was removed at garage. Nope no foulplay. The mechanic .the buyer and I all felt real bad about all this. So with out any other test or checking the motor we all sat down and talked it over.
The end result was ,I sold the tracker,the buyer was happy with the price differance and the mechanic only charged for the inspection but not for the timing belt tear down and no charge for towing to buyers garage.
It all worked out.
I am now trackerless.
But I also bought 2000 Gran Vitara wich needs new timing chains.And a retired suki mechanic that will do the work for only $40 per hr.
1: cheap china knock off belt ( Im 100% Gates, so is many new Toyotas and others)
there are others as good.
2: Some mech. will try to cut a fat hog by buying that $12 advanced xxxxx belt.
you know the one that has a that FUNNY name on the side, "untraceable to any source"
3: set the belt down with marks wrong. ran motor ,crashed valves, belt snapped.
4: mech , thinks belt is like a serpentine belt (no not even close) and sets it to 100 lbs.
5: belt could be defective. but I'd bet a quality belt is not defective.
ISO9000 spec belt. nahhhhhhhhhhh
i can only say what might be, i dont have all the facts but i bet you do .
what markings are on the box. would like to know that.
